c) When acting as Third Surveyor: In the event of the Surveyors failing to agree, resolve the dispute by visiting the property, examine all evidence from both sides and publish an Award including the apportionment of costs.
Buildings may be subdivided, and the owner of each part has to be served Notice and have an Award. There are often several “owners” of the same premises, because of the definition in the Act, such as freeholder, head lessee, occupational lessee and sub-tenants.
It is customary to charge fees for Party Wall Matters on a time charge basis. Generally speaking, the owner having the work done will have to pay.
